CUSTOMERS
In support of all our authorized retail dealers, and as a condition for buying wholesale from us, we require that our jewelry be sold at minimum full retail price. This is defined at minimum as keystone. We do not allow our products to be represented at retail at a discount. To qualify as a Philip Zahm Designs retail business partner, your initial purchase total must exceed a certain amount and you must provide the following information and documents:

Tax ID Number from the State in which you operate

Valid Resale License Number
3.
Customer Credit Agreement
4. Credit Release Authorization
5.
USA Patriot Act Compliance Form
If your initial order is less than the specified minimum amount you will not qualify as a Philip Zahm Designs authorized retail business partner and therefore not be eligible for retail sales and marketing support.
MEMORANDA
All items are automatically sent as consigned on memorandum when ordered. We will typically call on memoed goods within 14 days. If the item(s) are not returned within 30 days, it will be considered a "sale" and we will send you an invoice. Please contact us for additional information regarding terms and basic order requirements. We reserve the right to pull any or all pieces back or request a drop ship to another customer at any time.
SALES ORDERS
All of our pieces are handmade and unique. We usually have at least one piece of each design for each gemstone we carry. If we do not have what your customer is looking for, we are more than pleased to turn that specific request into a beautiful piece of jewelry (see below: Special Orders).
PURCHASES
If you call to purchase something, we will send a bill with the item(s) and standard billing terms - 30 days net - will be applied. Additional terms may be applied under special circumstances if you have unique requests and a superior pay history.
CREDIT
If you are a new client, 3 credit references will be required.
A good JBT rating is of course always helpful.
DISCOUNTS
It is the policy of Philip Zahm Designs not to discount. We do reserve the right to offer two annual special promotions at our discretion. These promotions will be made avaiable to all Philip Zahm Designs customers.
BILLING TERMS
Our standard terms are net 30 days unless otherwise negotiated at the time of sale. Finance charges of 1.5% will be assessed monthly on all past due balances. We reserve the right to turn all past due accounts over to the JBT Collection Department after a reasonable collection effort on our part.
LATE FEES
Late fees will be applied after 30 days with a 18% APR. If there is an excessive balance past 90 days, no new orders will be sent out. After 180 days of non-payment, the amount due will be turned over to a collection agency and reported to JBT.
RESTOCKING FEES
All unauthorized returns will be charged with a 25% restocking fee and result in a cancellation of previously approved credit. All authorized returns will be charged with a 10% restocking fee unless the return is part of our stock balance program.
PAYMENT
We accept cash payments in American dollars, check payments with checks issued by an established bank located in the United States, money wires, VISA and MASTERCARD issued by an established bank located in the United States. All bounced checks will be reported to the District Attorney of Santa Cruz [Civil Code, §1719(a)(2)] Please download our Credit Card Payment form to make a payment.
STOCK BALANCE PROGRAM
Philip Zahm Designs will exchange 1 old piece for 2 new pieces for up to 30% of purchase value within one (1) year of the date on the invoice. All exchanges must be approved prior to return. All stock balance items must be returned within 30 days after the date of approval.
SPECIAL ORDERS
Philip Zahm Designs delights in special orders and has a unique capability to produce a custom piece for you and your customer. This commitment to quality and service requires us to insist that all special order pieces are non-returnable. If we cut stones or make jewelry to your specifications, these altered items cannot be returned for credit or be part of any stock balance agreement. Please take note that the handling time for special orders is between 6 and 8 weeks and that we require a 50% down payment and a signed order form.
RING SIZING
Our commitment is to provide the highest quality product and service to our customers. Because of this commitment, Philip Zahm Designs will size, one (1) time, a ring up or down one (1) size for free. When the sizing request is greater than one (1) size, this falls in the category of a special order as such work is a fundamental remake of the piece. The total cost is dependant on current gold price.
QUALITY CONTROL
Recipient accepts liability for any item not reported to Philip Zahm Designs as damaged within five (5) days from date of delivery.
SHIPPING PROCEDURES
Packages must be requested prior to 2:00 PM Pacific Standard Time to ensure same day shipping. Requests after 2:00 PM will be sent out the following day. We use FedEx for Priority Overnight and 2-day deliveries. We do not ship UPS. When a package is not requested for Priority Overnight or 2-day FedEx delivery, we use USPS Express, USPS Registered or USPS Insured Mail depending on the value. Recipient accepts liability for any item not reported to Philip Zahm Designs as missing within two (2) days from date of delivery. Packaging must be retained for insurance purposes in the event items listed are not received or damaged. Please download our approved return procedure document. Philip Zahm Designs reserves the right to refuse and return any package without an RA-number and/or a package with unauthorized items.
SHIPPING PROCEDURES FOR SALES RETURNS
Do not send jewelry or gemstones back without a return authorization (RA). Please download and fill out the following document: RA. Fax your request to our California Office in order to receive a Return Authorization Number. To the extent possible please return items in their original packaging, including all bags, envelopes and boxes. Package the merchandise securely, address to the attention of Customer Service, and ship insured. Philip Zahm Designs cannot be responsible for returned merchandise if these procedures are not followed.
SHIPPING CHARGES
When you call Philip Zahm Designs for jewelry and/or gemstones the amount of the sale will determine which party pays for the shipping. If the item is sent as consigned on memorandum you pay for the shipping charges. When we solicitate you we pay all the shipping charges.
DIAMOND ORDERS
It is true that we make use of diamonds in our jewelry designs, but we do not trade in loose diamonds. Unless otherwise requested we use VS1-GH Belgian Diamonds in our jewelry line.
ADVERTISING AND MARKETING
Philip Zahm Designs will offer a 5% co-op advertisement and marketing program based on the total expenditure at wholesale of the money spent by a customer in the last twelve (12) months. Under the 5% cap, Philip Zahm Designs will pay for 50% of all approved ads, upon receipt of a copy of the bill. It is the intention of Philip Zahm Designs to have all advertising be consistent with our brand image and of the highest quality possible. We must verify that your display or advertising is consistent with this intention; therefore we reserve the right to withhold permission and approval of expenditure when we feel the display or advertising is not adequate. Please email or call us with your proposal for promoting a Philip Zahm Designs piece of jewelry and/or gemstone. All promotions must be approved and utilize approved Philip Zahm Designs imagery - including the logotype. This is available online - to be downloaded via a HTTP source or uploaded via FTP to desired location and on CD/DVD to be sent via USPS Mail - in a press ready format. |
